Who can use the marketplace
The marketplace is for teachers and other adults who make or use classroom resources. Accounts are for adults only. There are no student accounts, no student logins, and no features meant for children. Do not use the marketplace to collect or share information about students.
For now the marketplace serves buyers and sellers in the United States only.
Your account
You sign in with an email link or with Google. Keep access to your email account secure, because anyone who can read your email can sign in as you. You are responsible for what happens under your account. Tell us at once if you think someone else has used it.
Selling: what you grant us and what you keep
You keep the copyright in everything you upload. When you publish a listing, you give us a non-exclusive license to host your files, make preview images from them, add a buyer watermark to downloads, show your listing, and sell licenses to it on your behalf. "Non-exclusive" means you can sell the same resource anywhere else, at any price, at the same time.
You can unpublish or remove a listing at any time. Teachers who already bought it keep their license and can still download the version they bought.
You promise that you own or have licensed everything in your files and previews, including clip art and fonts, and that the license covers selling it in a paid digital product. The seller policies explain this in more detail.
Buying: your license
When you buy a resource you get a license to use it, not ownership of the copyright. Each license covers one teacher and one classroom, for life. You can buy more than one license for colleagues. You may not share, resell, or redistribute the files. The full terms are in the buyer license.
Fees and payouts
Buyers pay the listed price plus any sales tax. From each sale, we keep a platform fee of 10 percent of the item price. The card processing fee charged by our payment processor is also taken from the seller's share. Every sale statement shows both amounts. The fee page has worked examples.
Sellers are paid through Stripe Connect Express. You need to finish Stripe's onboarding, including its identity checks, before payouts can start. Stripe sends payouts to your bank on its schedule. Stripe's own terms also apply to your Stripe account.
Sales tax
Sales tax is calculated at checkout by Stripe Tax and added on top of the price. The buyer pays it. Where we are registered to collect tax as a marketplace, we collect and remit it, so sellers do not collect sales tax on marketplace sales themselves.
What you may not upload
Do not upload or link to:
- student work, student data, or images where a student can be identified
- work you do not have the right to sell, including other people's resources, publishers' materials, and unlicensed clip art or fonts
- trademarked characters or brands you have no license to use
- AI output presented as your own original work without disclosure
- malware, or files that do anything other than what the listing describes
- adult or sexual content
- other people's personal information
- previews that do not match the files a buyer receives
We may remove listings, withhold payouts tied to removed listings while we investigate, or close stores that break these rules.
AI-made content
Every listing says whether AI was used: not at all, as an assistant, or to generate content. You must answer honestly. Paid listings that are mostly AI-generated are reviewed before they go live, and search does not boost them.
Buyers do not receive any exclusive rights in AI-generated images. Copyright may not protect purely AI-generated material, so no one can promise exclusivity over it.
Copyright complaints and repeat infringers
We respond to copyright notices that meet the requirements of the Digital Millennium Copyright Act. A seller whose listing is removed can send a counter-notice. A store that receives three valid copyright strikes is closed. Details are in the DMCA policy.
Refunds
Refunds are available for a misrepresented listing, a broken or unusable file, or a duplicate purchase, within 365 days. The refund policy explains how to ask.
Ending your account
You can ask us to delete your account at any time. We keep order and payout records that tax and dispute rules require us to keep, as the privacy policy explains.
We may suspend or close an account that breaks these terms, puts other users at risk, or that the law requires us to close. When we close a store, buyers keep the licenses they already bought.
Changes to these terms
When we change these terms in a meaningful way, we raise the version number at the top of this page and update the date. Git history of these pages is our record of every change. This version does not ask you to accept each new version again; whether to do that is an open decision for a later release.
Governing law
These terms are governed by the laws of {{GOVERNING_LAW}}, without regard to conflict of law rules.
