DRAFT: lawyer review required before launch
DMCA and Copyright Policy
Version 1, last updated
We respect copyright, and we expect sellers to sell only what they made or have licensed.
Reporting a copy of your work
If a listing copies your work, send a notice through the copyright takedown form or to our designated agent below. We act on notices that include what 17 U.S.C. 512(c)(3) requires:
- Your physical or electronic signature.
- Identification of the work you say is infringed.
- The listing link, so we can find the material.
- Your name, address, phone number, and email.
- A statement that you believe in good faith the use is not authorized by you, your agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you own the copyright or may act for the owner.
When a notice is complete, we take the listing down and tell the seller.
Counter-notice
A seller who believes a listing was removed by mistake, or that they have the right to sell it, can send a counter-notice. If the person who complained does not tell us within 10 to 14 business days that they have gone to court, we may restore the listing.
Repeat infringers
A store that receives three valid copyright strikes is closed. A strike that is withdrawn, or reversed after a counter-notice, does not count.
